RULES OF THE COMPETITION ‘Flexible in helping’ (‘Competition’)

§ 1

General Provisions

  • These Terms and Conditions set out the rules of the Contest “Flexible in Helping”.
  • The Organizer of the Contest is GENERAL LOGISTICS SYSTEMS POLAND spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Głuchowo, ul. Tęczowa 10, 62-052 Głuchowo, entered into the Register of Entrepreneurs by the District Court Poznań–Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number: 0000005009, REGON: 631058749, NIP: 7851561831 (hereinafter: the “Organizer”).
  • The entity acting on behalf of the Organizer to execute the Contest is Insignia sp. z o.o. with its registered office in Kraków, ul. Orląt Lwowskich 8, 31-518 Kraków, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Kraków–Śródmieście in Kraków, 11th Commercial Division of the National Court Register under KRS number: 0000476537, NIP: 6772376926 (hereinafter: the “Executor” or the “Agency”).
  • The Contest shall be conducted in accordance with these Terms and Conditions (hereinafter: the “Regulations”) available at: https://gls-group.eu/PL/pl/Elastyczni-w-pomaganiu/ and in accordance with Polish law, in particular the provisions of the Civil Code.
  • The Contest is not a game of chance, raffle, or promotional lottery within the meaning of Article 2(1) of the Act on Gambling Games of 19 November 2009 (Journal of Laws of 2025, item 595, as amended) and is not subject to the regulations contained in the said Act or in executive regulations thereto.
  • The Organizer informs that the Contest is not sponsored, supported, administered by, or in any way associated with Instagram. All questions, comments, complaints, and claims related to the Contest should be directed to the Organizer, not to Instagram. The Organizer undertakes to indemnify Instagram against any claims brought by any Contest Participant in connection with this Contest.

§ 2

Participants of the Contest

  • A Participant of the Contest may be a natural person who, during the Contest Period, meets all of the following conditions:
    a. is of legal age;
    b. has access to the Internet and an active account on www.instagram.com ;
    c. accepts the provisions of these Terms and Conditions;
    d. has full legal capacity;
    e. is familiar with and accepts the Terms and Conditions of the Poland Business Run 2025, available at: https://polandbusinessrun.pl/pl/runner-zone/regulamin-16 (hereinafter: the “Contest Participant”).
  • Contest Participants must act in compliance with the terms of use of www.instagram.com , available at: https://help.instagram.com/581066165581870/?locale=pl_PL .
  • Employees and representatives of the Organizer and the Agency, as well as their spouses, descendants, ascendants, and siblings, and persons meeting the above criteria in relation to other entities directly involved in preparing and conducting the Contest on behalf of the Organizer, may not participate. The right to verify compliance with the above conditions lies solely with the Organizer.
  • Participation in the Contest takes place via www.instagram.com , and therefore may depend on the technical and equipment capabilities available to the Participant.
  • Entry into the Contest must be made in the manner specified in these Terms and Conditions. Failure to meet any condition of entry shall render the entry invalid.
  • Participation in the Contest is permitted only personally, using one’s own personal Instagram account. Submissions on behalf of third parties or through third-party accounts are not permitted.

§ 3

Purpose and Duration of the Contest

  • The Contest is organized for the promotional purposes of the Organizer and to promote and popularize a healthy lifestyle.
  • The Contest will be announced on Instagram, on the Organizer’s profile https://www.instagram.com/gls.poland/ (hereinafter: the “Organizer’s Profile”) and on the Influencer’s profile https://www.instagram.com/qczaj/ (hereinafter: the “Influencer’s Profile”), through a jointly shared reel (hereinafter: the “Instagram Reels”).
  • The publication date of the Instagram Reels announcing the Contest and its rules (hereinafter: the “Contest Post”) on both the Organizer’s Profile and the Influencer’s Profile is set for 18 August 2025.
  • The Contest runs from the moment of publication of the Instagram Reels on 18 August 2025 until 23:59:59 on 28 August 2025 (hereinafter: the “Contest Period”).

§ 4

Contest Rules

  • In order to participate in the Contest, the Contest Participant must, during the Contest Period, fulfill all the conditions set out in these Terms and Conditions and perform the following contest task:
    a. watch the Instagram Reels shared on both the Organizer’s Profile and the Influencer’s Profile,
    b. provide – by means of a comment posted under the Instagram Reels – an answer to the question: “What is your idea for flexible helping?” (hereinafter: the “Open Question”),
    c. read these Terms and Conditions and, together with the answer to the Open Question, include in the comment under the Instagram Reels the statement: “I accept the Terms and Conditions of the Contest.”
  • Compliance with the requirements and criteria described in § 4 sec. 1 letters a–c above constitutes a valid contest entry, hereinafter referred to as the “Contest Entry” or the “Answer.” Submitting a Contest Entry also constitutes an explicit action by the Participant confirming (within the meaning of Article 4 point 11 of the GDPR) consent to the processing of their personal data for the purpose of conducting the Contest.
  • A Contest Entry must not:
    a. infringe any rights or interests of third parties, in particular personal rights or copyrights;
    b. contain vulgarities, offensive content, expressions of political or religious preferences, views or sympathies of the Participant, propaganda other than related to political or religious issues, pornographic content, discriminatory content, or any other content contrary to law or good morals;
    c. contain advertising content concerning entities other than the Organizer.
  • In the event that two identical Answers are submitted by two different Participants, or two or more Answers are submitted by one Participant, only the earlier submitted Answer will be considered valid, which means that later Answers will not participate in the Contest. A single Participant may take part in the Contest only once.
  • By submitting a Contest Entry, the Contest Participant confirms that they hold full copyright to the Answer given to the Open Question.
  • Only Contest Entries published during the Contest Period will be considered.

§ 5

Prize

  • The prize (hereinafter: the “Prize”) to be won in the Contest is:
    4 × participation in the Poland Business Run, which will take place on 7 September 2025 in Kraków – running as part of the Organizer’s team, with a value of PLN 196.80 gross per participant.
  • The Prize also includes accommodation (with a value of PLN 550 gross) in a hotel located in Kraków on the day preceding the run, as well as a lump-sum cash amount of PLN 350 to cover travel expenses to Kraków, which will be paid to the Winner after taking part in the run.
  • The total value of the Prize awarded to one participant amounts to PLN 1,096.80 gross.
  • The Prize awarded in the Contest is not subject to exchange for another prize. The Contest Participant is also not entitled to request the exchange of the Prize for its cash equivalent.
  • An additional cash prize in the amount of 11.11% of the gross value of the Prize (rounded to full zlotys) shall be added to the Prize, which shall immediately be withheld by the Executor as the payer of a 10% lump-sum personal income tax on prizes awarded in the Contest, and remitted to the competent tax office. Withholding of the flat-rate tax on the value of the Prizes means that the additional cash prize referred to in this paragraph will not be paid out to the Winner of the Contest, within the meaning of § 6 sec. 2 below.
  • Winners of the Prize have the right to refuse acceptance of the Prize. A refused Prize shall pass to the next person in the ranking, and Winners who resign are not entitled to any financial compensation in this respect.

§ 6

Selection of Winners and Awarding of Prizes

  • From among the Contest Entries that meet the requirements of these Terms and Conditions, the Organizer shall select four Contest Winners who have created the most creative, original, and imaginative answers to the Open Question.
  • A Participant whose Contest Entry is selected according to the criteria specified in sec. 1 above shall hereinafter be referred to as the “Prize Winner” or the “Laureate.”
  • Information about the Contest Winners shall be published on 29 August 2025 in the form of a comment under the Contest Post on both the Organizer’s Profile and the Influencer’s Profile. The list of Laureates shall include their Instagram identifiers (nicknames).
  • Within 1 working day of announcing the list of Prize Winners, the Organiser (through the Administrator) will contact each Winner via a private message on Instagram to arrange the details of the Prize delivery and obtain the data specified in § 6(5) of the Rules.
  • In order to meet the condition of the Competition referred to in § 6(4) above, the Winner should, within 2 working days of receiving the above-mentioned message from the Organiser (via the Administrator):
    a. send the Organizer, by private Instagram message, the following data: full name, telephone number, and email address – for contact purposes;
    and subsequently:
    b. by email correspondence, send the Executor a message providing their date of birth – to confirm legal age – as well as the address of their competent tax office – for the purpose of tax settlement and submission of the tax return, and provide any other data requested by the Executor necessary for the settlement of taxes on the Prizes.
  • Failure by a Laureate to respond, or failure to provide all the required data as specified in § 6 sec. 5 within the indicated time limit, shall result in the Prize being awarded to another Laureate selected in accordance with these Terms and Conditions.
  • The Organizer shall not be held liable for any inability to notify a Prize Winner about their win or inability to award the Prize due to the Contest Participant providing incorrect contact details or for other reasons attributable to the Participant.

§ 7

Processing of Personal Data

  • The personal data of Contest Participants shall be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: the “GDPR”).
  • The joint controllers of the personal data of the Contest Participants are:
    a) GENERAL LOGISTICS SYSTEMS POLAND spółka z ograniczoną odpowiedzialnością, with its registered office in Głuchowo, ul. Tęczowa 10, 62-052 Głuchowo – for the purposes indicated below in § 7 sec. 5 (a), (c), (e), (f), (g) of the Terms and Conditions; and
    b) Insignia sp. z o.o., with its registered office in Kraków, ul. Orląt Lwowskich 8, 31-518 Kraków – for the purposes indicated below in § 7 sec. 5 (b), (d), (e), (f) of the Terms and Conditions.
  • For all matters related to the processing of your personal data for the purposes of the Contest, please contact us by email at: dataprotection@gls-poland.com or konkurs@insignia.pl.
  • In connection with participation in the Contest, we collect personal data of the Contest Participants to the following extent:
    a) the Contest Participant’s Instagram username (nickname);
    b) in the case of Prize Winners:
    a. first name, last name, email address, telephone number – for contact purposes;
    b. date of birth – for the purpose of confirming legal age;
    c. other data necessary to carry out tax settlements.
  • The personal data of the Contest Participant shall be processed for the following purposes:
    a) participation in the Contest (based on Article 6(1)(a) GDPR);
    b) taking action at the request of the data subject – in the case of a complaint submitted by the Participant (based on Article 6(1)(f) GDPR);
    c) selection and announcement of Prize Winners (based on Article 6(1)(a) GDPR);
    d) handling of tax matters related to the Contest (based on Article 6(1)(c) and (f) GDPR);
    e) recording and disseminating the Contest Entry in accordance with § 9 of these Terms and Conditions (based on Article 6(1)(b) GDPR);
    f) managing requests regarding data subject rights, recording the history of submissions in line with the accountability principle, and for the purposes of establishing, pursuing, or defending against claims (based on Article 6(1)(f) GDPR);
    g) transferring Laureate data to the relevant hotel to carry out the reservation related to the Prize (based on Article 6(1)(f) GDPR).
  • To ensure proper organization of ongoing activities of the Organizer and for purposes related to the Contest, the recipients of the Contest Participants’ personal data may include:
    a) the Influencer (exclusively with regard to co-sharing the Instagram Reels and the Contest Post on the Influencer’s Profile);
    b) providers of legal and advisory services supporting the Organizer and the Executor in pursuing potential claims (in particular law firms);
    c) providers of services supplying the Organizer and Executor with technical and organizational solutions supporting business processes (in particular IT service providers, hosting companies, hotels).
  • The personal data of Contest Participants shall be processed by the Organizer and Executor for the duration of the Contest, its settlement, awarding of Prizes, and handling of complaints, and subsequently for archival and accounting purposes for a period compliant with applicable legal regulations.
  • Contest Participants have the right to access their personal data, rectify, erase, or restrict processing, as well as the right to data portability. To exercise these rights, the Participant may contact the Organizer or Executor at the email addresses indicated in § 7 sec. 3 of the Terms and Conditions.
  • Contest Participants have the right to lodge a complaint regarding the Organizer’s processing of personal data with the President of the Personal Data Protection Office – the supervisory authority for data protection in Poland.
  • A Contest Participant may withdraw previously granted consent to the processing of their personal data at any time by submitting an appropriate declaration in a document form allowing the Organizer or Executor to become acquainted with its content (e.g., email, Instagram message). Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
  • The personal data of Contest Participants shall not be subject to automated decision-making (including profiling).
  • The personal data of Contest Participants shall not be transferred by the Organizer or Executor outside the European Union. In the case of contests organized on the Instagram platform, data transfer outside the European Economic Area shall be carried out in accordance with Instagram’s Privacy Policy and Terms of Use ( https://pl-pl.facebook.com/help/instagram/581066165581870 ).

§ 8

Complaints

  • Complaints concerning the manner of conducting the Contest may be submitted in writing to the Organizer’s address indicated in § 1 sec. 2 of these Terms and Conditions, or electronically to the email address: konkurs@insignia.pl with the note “Flexible Helping Contest – Complaint.”
  • The complaint should include the following:
    a) the name, surname, and exact address of the Contest Participant, as well as the email address used to participate in the Contest;
    b) a detailed description and the reason for the complaint;
    c) the Contest Participant’s request related to the submitted complaint.
  • Complaints shall be considered by the Organizer immediately, no later than within 14 (fourteen) days from the date of their receipt.
  • Contest Participants shall be notified of the Organizer’s decision by email to the address from which the complaint was sent or by post, depending on how the complaint was submitted.

§ 9

Intellectual Property Rights

  • By submitting a Contest Entry in accordance with § 4 of the Terms and Conditions, the Contest Participant declares that:
    a) they are the sole author of the submitted Contest Entry within the meaning of the provisions of the Copyright and Related Rights Act of 4 February 1994 (Journal of Laws of 2022, item 2509, as amended), and that their economic copyrights to the Contest Entry are not encumbered with the rights of third parties, and that the Contest Entry has not been previously published or entered into another contest;
    b) their Contest Entry does not violate applicable law, the rights of third parties (including copyright, image rights, personal rights), or good morals.
  • By submitting a Contest Entry in accordance with § 4 of the Terms and Conditions, the Contest Participant grants the Organizer, free of charge, a non-exclusive, territorially unlimited, and time-unlimited license (with the right to sublicense) to use the Contest Entry, including by:
    a) recording and reproducing the Contest Entry by any technique, including printing, reprography, magnetic recording, digital technique, in the form of any medium, including electronic storage media;
    b) publicly sharing the Contest Entry in such a way that anyone can access it at a place and time chosen by them, including on the Internet (in particular on the Organizer’s website and on the Organizer’s profiles on social media such as Instagram, Facebook, LinkedIn, TikTok, YouTube);
    c) using the Contest Entry for promotional and marketing purposes related to the Contest and the Organizer’s activities;
    d) displaying, reproducing, broadcasting, and re-broadcasting, as well as making the Contest Entry publicly available in such a way that anyone can access it at a place and time individually chosen by them;
    e) adapting the Contest Entry, including modifying, editing, altering its layout, form, or adding other elements, provided that such actions do not infringe the author’s moral rights.
  • Upon awarding the Prize, the Contest Participant additionally undertakes to refrain from exercising the author’s moral rights to the Contest Entry in a manner that would prevent or hinder the Organizer’s use of the Contest Entry in accordance with the license referred to in sec. 2.
  • The Organizer shall have the right to grant further licenses (sublicenses) to third parties, to whom it entrusts the implementation of marketing or promotional activities, including in connection with the Contest.

§ 10

Final Provisions

  • The content of these Terms and Conditions shall be available throughout the entire duration of the Contest on the Organizer’s Profile in the “Bio” tab as a hyperlink to the Organizer’s website containing the Terms and Conditions, as well as at the Organizer’s registered office.
  • Any information about the Contest contained in promotional and advertising materials shall be for informational purposes only. The legal basis for conducting the Contest shall be these Terms and Conditions.
  • The Organizer reserves the right to amend the provisions of the Terms and Conditions, provided that such changes do not infringe the acquired rights of the Contest Participants. Amendments to the Terms and Conditions shall enter into force on the date of their publication in the manner specified in § 10 sec. 1.
