RECRUITMENT PRIVACY NOTICE

In this Recruitment Privacy Notice we want to inform you about how we handle your personal data during the application process and outline your rights under the European Data Protection Regulation (GDPR) or otherwise applicable national regulations. All terms used in this Privacy Notice shall have the meaning as defined in the GDPR.

DATA CONTROLLER

Any personal information you provide will be processed for the purposes mentioned below by General Logistics Systems B.V., Oude Meer, Netherlands (hereinafter referred to as GLS Group or data controller), that is operating the GLS Career Website and conducting recruitment for the positions within the GLS Group. If necessary for these purposes, personal data may be shared with GLS Group affiliated companies.

The GLS Group affiliated companies in principles conduct their own recruitment locally, within their own scope and for their own purposes. In that respect local recruitment privacy notices apply. GLS Group and affiliated companies manage the talent pool of interested candidates together and personal data of candidates’ acquired locally can be exchanged between them.

PURPOSE AND LEGAL BASIS OF PERSONAL DATA PROCESSING

Your personal data is processed for the purpose of recruitment for the position indicated in the job advertisement you are applying to and / or for the purpose of including you in our talent pool and future recruitments, on the condition you have provided your consent.


CATEGORIES OF PERSONAL DATA

In the course of the recruitment process we process personal data which is necessary to participate in the recruitment process and additionally personal information that you have decided to share with us in your application documents, based on your consent.

We process the following categories of personal data as part of the application process:

  • Basic data (e.g. first name, family name, contact data, e-mail address, phone number);
  • Log in data when using GLS Group Career Website (e.g. login, password, IP address);
  • Information regarding educational background, acquired skills, diplomas and certificates;
  • Information regarding professional background (employment history, references);
  • Image (e.g. photos included in your application documents).

The above list is not exhaustive and may vary depending on the job requirements and the content of documents submitted by you. Provision of any additional personal information, beyond data that is necessary for the recruitment, does not affect your ability to take part in the process.


LEGAL BASIS FOR PROCESSING OF PERSONAL DATA:

  • Your consent expressed by way of applying to the job advertisement or sending us your open application and provision of respective documents, i.e. Article 6(1)(a) GDPR or Article 9(2)(a) GDPR (in case, where the application documents contain special category data as defined in Article 9(1) GDPR, e.g. data concerning disabilities);
  • Article 6(1)(b) GDPR - necessity to take action prior to entering into a contract (in case of recruitment concerning other civil law contract or traineeship);
  • Article 6(1)(c) GDPR - necessity to comply with a legal obligation (only for recruitment concerning a contract of employment);
  • Legal basis for the purposes of establishing, investigating or defending against claims (if necessary and justified):
  • Article 6(1)(f) GDPR - i.e. the legitimate interest of the data controller in being able to establish, assert or defend against claims,
  • Article 9(2)(f) GDPR - i.e. the necessity to establish, assert or defend claims in the case of special categories of data.

You can withdraw your consent at any time.


TALENT POOL

At GLS our goal is to acquire most promising candidates from the market and place them in the best possible way. For that reason, we have created our global recruiter community and talent pool.

As part of the application process, you can also consent to be included in our talent pool and have your application information considered for future vacancies and to allow us to contact you about future vacancies.

If you do not consent to the processing of your personal data for future recruitments, you will not be included in them and your personal data will be deleted upon expiry of the retention period as set out below.

SOURCES OF DATA The main source of personal data is your application with us. In case a recruitment agency is involved in the employment process, we may have received the following categories of Personal data from the agency: first name(s) and surname, date of birth, contact details indicated by the candidate, information on education, professional qualifications and previous employment history, as well as other personal data provided by the candidate.


RECIPIENTS OF THE DATA

The candidate's data may be transferred to entities with whom GLS Group has entered into a contract for the provision of services, such as recruitment agencies, independent recruiters working with GLS Group, consultants, providers of IT tools and systems supporting the recruitment processes and other GLS Group companies.

Your personal data may be shared within the GLS Group if this is necessary for the fulfilment of the purpose, in particular for the purpose of receiving and processing your application.

In case we use service providers to fulfil our obligations, your personal data is processed in accordance with a respective Data Processing Agreement.

Outside the European Union (EU) or the European Economic Area (EEA), we transfer personal data only to third countries for which an adequate level of protection has been confirmed by the EU Commission or for which other adequate data protection guarantees (e.g. binding internal company data protection regulations or EU standard contractual clauses) are in place or legal circumstances permit the transfer. In addition, where required by applicable data protection laws, further safeguards (e.g. encryption and additional contractual arrangements) will be put in place to ensure an adequate level of protection for your personal data.


DATA RETENTION PERIOD

To the extent that the processing of personal data is based on consent, the data will be processed until the consent is withdrawn, but no longer than the expiry of the below retention periods:

Your personal data will be kept for the entire duration of the recruitment process and additional 6 months after its completion.

If you have consented to join the talent pool, your personal information will be processed until you revoke your consent or otherwise for a period of 24 months from from granting the consent the completion of the recruitment process or in case of open applications,.

Where necessary and justified, your personal data will be kept for the period necessary to establish, assert or defend against claims.


AUTOMATED DECISION-MAKING

The candidate's data will not be processed in a manner that is related to automated decision-making, including profiling.


YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA

In relation to our processing of your personal data, you have the following rights:

Right to withdraw consent

To the extent the processing of personal data is based on the consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing previously carried out on that basis.

Right to information

You may request information as to whether your personal data is being processed. If this is the case, you may request further information, in particular on the purposes of processing, the categories of personal data processed, the recipients, the storage period or, if this is not possible, the criteria for determining the period, as well as further information. You may request a copy of your personal data, which will be provided to you in the event of a request by e-mail in a commonly used electronic format, provided that this does not adversely affect the rights or freedoms of other persons.

Right to rectification

You may request that we correct any inaccurate personal data relating to you or complete any incomplete personal data without undue delay.

Right to erasure

You may request the immediate deletion of your personal data. Your personal data will only be stored by us for as long as it is required for the specified purpose or for as long as we are required by law to retain the data. As soon as the purpose has been fulfilled or your personal data is no longer required for data processing, we will delete it.

In addition, it is possible to process your personal data for another purpose in compliance with the statutory provisions, for example: assertion or defence against legal claims. This purpose only exists as long as the limitation periods allow the assertion of legal claims.

Right to restriction

You may request the restriction of the processing of your personal data, in particular if

  • you dispute its accuracy and the data is being reviewed,
  • the processing is unlawful and you refuse to have it deleted,
  • the data is no longer required but you need it to assert, exercise or defend legal claims, or defence of legal claims, or
  • you have objected to the processing.

In the event of restriction, your personal data may in principle only be stored and, in particular, only processed with your consent or for the purpose of asserting or exercising or defending legal claims.

Right to data portability

At your request, we will transfer your data - insofar as this is technically possible - to another responsible party. However, you only have this right if the data processing is based on your consent or is necessary to perform a contract. Instead of receiving a copy of your data, you can also ask us to transfer the data directly to another data controller specified by you.

Right to object

You may object to the processing of personal data concerning you if the processing is based on a legitimate interest (Article 6(1), first sentence, point (f) DSGVO). The data will then no longer be processed unless compelling reasons for the processing are not demonstrated.

You also have the right to lodge a complaint with a relevant supervisory authority, in particular in the Member State of our or your residence or the place of the alleged infringement, if you consider that the processing infringes the General Data Protection Regulation.

We reserve the right to change this Recruitment Privacy Notice from time to time according to the changes in our services, the processing of your data or in the applicable law. We therefore recommend to visit our Recruitment Privacy Notice periodically.
